Terms of Service

1. Acceptance

By creating an account or using transactQ you agree to these Terms.

2. Eligibility

You must be at least 18 and authorized to act on behalf of any brokerage or business you represent.

3. Your Account

You're responsible for the activity that occurs under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.

4. Acceptable Use

You will use transactQ only for lawful real-estate transaction coordination. You will not (a) add a contact's phone number or email without that contact's permission and a transactional relationship to the deal, (b) attempt to send marketing, promotional, or unrelated content through the SMS or email features, (c) probe or attempt to bypass security controls.

5. Communications Compliance

You acknowledge that messages you trigger through transactQ are subject to the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and applicable mobile-carrier rules. You represent that every phone number you add to a transaction belongs to a person you have a current transactional relationship with, who has agreed to be contacted about the transaction. transactQ implements a double opt-in for SMS (described in the SMS Program Terms) on your behalf.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may modify or discontinue features with notice.

7. Fees

Pricing, if any, will be presented in-app before charges occur.

8. Intellectual Property

transactQ and its content are owned by us. You retain ownership of the transaction data you enter.

9. Disclaimer

transactQ is provided "as is." We do not warrant that the service will be error-free or meet any specific requirement. transactQ is a coordination tool and not legal, accounting, or real-estate advice.

10. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service will not exceed the amount you paid us in the prior 12 months, or $100 if no payments were made.

11. Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-laws principles.

12. Changes

We may update these Terms; we'll change the "Last updated" date and, for material changes, notify you in-app.
